Hintergrund zu TSCA Toxic Substances Control Act Reporting:
Auf Grundlage der durch Frank R. Lautenberg Chemical Safety for the 21st Century Act geänderten Fassung des Toxic Substances Control Act (TSCA) hat die US-Umweltschutzbehörde United States Environmental Protection Agency (EPA) zum 06. Januar 2021 weitere Maßnahmen gegen 5 persistente, bioakkumulative und toxische Chemikalien (PBT) ergriffen und eine strenge Regulierung dieser Chemikalien eingeführt. Detaillierte Inforationen finden Sie HIER.
Es geht um Verbote und Beschränkungen für die Herstellung (einschließlich Einfuhr), Verarbeitung und den Vertrieb folgender Chemikalien:
PIP (3:1) – phenol, isopropylated phosphate (3:1) (CAS 68937-41-7)
Die Verwendung wurde ab dem 08. März 2021 für eine Reihe von NAICS-Codes prinzipiell verboten!
Gemäß „No Action Assurance“ wurde im März 2021 ein „Delay of enforcement of PIP (3:1)“ ausgerufen, womit die Regelung hierzu für 180 Tage ausgesetzt wird.
DecaBDE – decabromodiphenyl ether (CAS 1163-19-5)
Die Verwendung wurde ab dem 08. März 2021 für eine Reihe von NAICS-Codes prinzipiell verboten!
HCBD – hexachlorobutadiene (CAS 87-68-3)
Die Verwendung wurde ab dem 08. März 2021 für eine Reihe von NAICS-Codes prinzipiell verboten!
PCTP – pentachlorothiophenol (CAS 133-49-3)
Die Verwendung wurde ab dem 08. März 2021 bei einer Konzentration von mehr als 1% w/w für eine Reihe von NAICS-Codes prinzipiell verboten!
TTBP – 2,4,6-tris(tert-butyl)phenol (CAS 732-26-3)
Die Verwendung wird voraussichtlich ab dem 06. Januar 2026 bei einer Konzentration von mehr als 0,3% w/w in Behältern von kleiner 35 Gallonen für eine Reihe von NAICS-Codes prinzipiell verboten!
Anmerkung:
US-Unternehmen können wegen Nichteinhaltung der Beschränkung mit Bußgeldern von bis zu 50.000 USD pro Tag bestraft werden.

Background to TSCA Toxic Substances Control Act Reporting:
Based on the version of the Toxic Substances Control Act (TSCA) as amended by Frank R. Lautenberg Chemical Safety for the 21st Century Act, the United States Environmental Protection Agency (EPA) took further measures against 5 persistent, bioaccumulative substances effective January 6, 2021 and toxic chemicals (PBT) and strict regulation of these chemicals in place. You can find detailed information HERE.
It deals with bans and restrictions on the manufacture (including import), processing and distribution of the following chemicals:
PIP (3:1) – phenol, isopropylated phosphate (3:1) (CAS 68937-41-7)
As of March 8, 2021, the use was prohibited for a number of NAICS codes!
According to “No Action Assurance”, a “Delay of enforcement of PIP (3: 1)” was declared in March 2021, which means that the relevant regulation is suspended for 180 days.

As of March 8, 2021, the use of a concentration of more than 1% w/w was prohibited for a number of NAICS codes!
TTBP – 2,4,6-tris(tert-butyl)phenol (CAS 732-26-3)
The use is expected to be prohibited in principle for a number of NAICS codes from January 6, 2026 at a concentration of more than 0.3% w/w in containers of less than 35 gallons!
Note:
US companies can be fined up to $ 50,000 per day for failing to comply with the restriction.
